General Rules of Procedure<\/h2>\n<div class=\"su-spoiler su-spoiler-style-default su-spoiler-icon-plus h-toaccordion includetocloseall u-indent-1\" data-anchor=\"section-i-1\" data-scroll-offset=\"50\" data-anchor-in-url=\"yes\"><div class=\"su-spoiler-title\" tabindex=\"0\" role=\"button\"><span class=\"su-spoiler-icon\"><\/span><h3>1. Identification of relevant data<\/h3><\/div><div class=\"su-spoiler-content su-u-clearfix su-u-trim\">\n<p>Upon receipt of an admissible request for access to data, correction and\/or deletion of data processed in the INTERPOL Information System (IIS), the Commission shall notify the General Secretariat of the request and make the information contained therein available to it, pursuant to <a href=\"https:\/\/europeancourt.org\/en\/documents\/interpol\/commission-control-files\/statute\/#article-33\" title=\"Article 33(1) of the Statute of the Commission for the Control of INTERPOL\u2019s Files\">Article 33(1) of the Statute of the Commission for the Control of INTERPOL\u2019s Files<\/a>. The General Secretariat shall then notify the CCF within 45 days whether data concerning the applicant are being processed in the IIS (<a href=\"https:\/\/europeancourt.org\/en\/documents\/interpol\/commission-control-files\/statute\/#article-33\" title=\"Article 33(2) of the Statute of the Commission for the Control of INTERPOL\u2019s Files\">Article 33(2) of the Statute of the Commission for the Control of INTERPOL\u2019s Files<\/a>).<\/p>\n<\/div><\/div>\n<div class=\"su-spoiler su-spoiler-style-default su-spoiler-icon-plus h-toaccordion includetocloseall u-indent-1 su-spoiler-closed\" data-anchor=\"section-i-2\" data-scroll-offset=\"50\" data-anchor-in-url=\"yes\"><div class=\"su-spoiler-title\" tabindex=\"0\" role=\"button\"><span class=\"su-spoiler-icon\"><\/span><h3>2. Examination of request<\/h3><\/div><div class=\"su-spoiler-content su-u-clearfix su-u-trim\">\n<p>The CCF examines requests on the basis of the information available to it. During this process, the applicants can submit to the CCF additional information and corresponding documents relevant to the examination of their requests (such as previous and current functions, pending legal actions, etc.) in a concise manner, via the CCF Portal only. In accordance with <a href=\"https:\/\/europeancourt.org\/en\/documents\/interpol\/commission-control-files\/statute\/#article-34\" title=\"Article 34 of the Statute of the Commission for the Control of INTERPOL\u2019s Files\">Article 34 of its Statute<\/a>, the CCF may also seek additional information or clarification from applicants, sources of data challenged, the INTERPOL General Secretariat (IPSG) or other entities concerned by the request.<\/p>\n<\/div><\/div>\n<div class=\"su-spoiler su-spoiler-style-default su-spoiler-icon-plus h-toaccordion includetocloseall u-indent-1 su-spoiler-closed\" data-anchor=\"section-i-3\" data-scroll-offset=\"50\" data-anchor-in-url=\"yes\"><div class=\"su-spoiler-title\" tabindex=\"0\" role=\"button\"><span class=\"su-spoiler-icon\"><\/span><h3>3. Communication with the CCF after the submission of a request<\/h3><\/div><div class=\"su-spoiler-content su-u-clearfix su-u-trim\">\n<p>The CCF is the only point of contact of applicants during the examination of their requests (<a href=\"https:\/\/europeancourt.org\/en\/documents\/interpol\/commission-control-files\/statute\/#article-31\" title=\"Article 31 of the Statute of the Commission for the Control of INTERPOL\u2019s Files\">Article 31 of the Statute of the Commission for the Control of INTERPOL\u2019s Files<\/a>).<\/p>\n<\/div><\/div>\n<div class=\"su-spoiler su-spoiler-style-default su-spoiler-icon-plus h-toaccordion includetocloseall u-indent-1 su-spoiler-closed\" data-anchor=\"section-i-4\" data-scroll-offset=\"50\" data-anchor-in-url=\"yes\"><div class=\"su-spoiler-title\" tabindex=\"0\" role=\"button\"><span class=\"su-spoiler-icon\"><\/span><h3>4. Communication of information connected to a request<\/h3><\/div><div class=\"su-spoiler-content su-u-clearfix su-u-trim\">\n<p>In accordance with <a href=\"https:\/\/europeancourt.org\/en\/documents\/interpol\/commission-control-files\/statute\/#article-35\" title=\"Article 35(2) of the Statute of the Commission for the Control of INTERPOL\u2019s Files\">Article 35(2) of its Statute<\/a>, prior to disclosing information connected with a request, the CCF shall consult the owner of that information. In case of restrictions, they shall be motivated and justified, as required by <a href=\"https:\/\/europeancourt.org\/en\/documents\/interpol\/commission-control-files\/statute\/#article-35\" title=\"Article 35(3) and (4) of the Statute of the Commission for the Control of INTERPOL\u2019s Files\">Article 35(3) and (4) of the Statute of the Commission for the Control of INTERPOL\u2019s Files<\/a>.<\/p>\n<\/div><\/div>\n<div class=\"su-spoiler su-spoiler-style-default su-spoiler-icon-plus h-toaccordion includetocloseall u-indent-1 su-spoiler-closed\" data-anchor=\"section-i-5\" data-scroll-offset=\"50\" data-anchor-in-url=\"yes\"><div class=\"su-spoiler-title\" tabindex=\"0\" role=\"button\"><span class=\"su-spoiler-icon\"><\/span><h3>5. Timeframes for decisions<\/h3><\/div><div class=\"su-spoiler-content su-u-clearfix su-u-trim\">\n<p>Based on <a href=\"https:\/\/europeancourt.org\/en\/documents\/interpol\/commission-control-files\/statute\/#article-40\" title=\"Article 40 of the Statute of the Commission for the Control of INTERPOL\u2019s Files\">Article 40 of the Statute<\/a>, the CCF shall generally decide on a request within four months for access requests and nine months for requests for deletion and\/or correction of data, starting from the date on which requests were declared admissible.<\/p>\n<\/div><\/div>\n<div class=\"su-spoiler su-spoiler-style-default su-spoiler-icon-plus h-toaccordion includetocloseall u-indent-1 su-spoiler-closed\" data-anchor=\"section-i-6\" data-scroll-offset=\"50\" data-anchor-in-url=\"yes\"><div class=\"su-spoiler-title\" tabindex=\"0\" role=\"button\"><span class=\"su-spoiler-icon\"><\/span><h3>6. Provisional measures<\/h3><\/div><div class=\"su-spoiler-content su-u-clearfix su-u-trim\">\n<p>Before deciding on a request and at any time during the examination of the request, the CCF can take provisional measures in relation to the data concerned (<a href=\"https:\/\/europeancourt.org\/en\/documents\/interpol\/commission-control-files\/statute\/#article-37\" title=\"Article 37 of the Statute of the Commission for the Control of INTERPOL\u2019s Files\">Article 37 of the Statute<\/a>). In cases where the CCF adopts such measures, it notifies the parties as set out in <a href=\"https:\/\/europeancourt.org\/en\/documents\/interpol\/commission-control-files\/statute\/#article-37\" title=\"Article 37 of the Statute of the Commission for the Control of INTERPOL\u2019s Files\">Article 37<\/a> and <a href=\"https:\/\/europeancourt.org\/en\/documents\/interpol\/commission-control-files\/statute\/#article-41\" title=\"Article 41 of the Statute of the Commission for the Control of INTERPOL\u2019s Files\">41<\/a> of its Statute.<\/p>\n<\/div><\/div>\n<div class=\"su-spoiler su-spoiler-style-default su-spoiler-icon-plus h-toaccordion includetocloseall u-indent-1 su-spoiler-closed\" data-anchor=\"section-i-7\" data-scroll-offset=\"50\" data-anchor-in-url=\"yes\"><div class=\"su-spoiler-title\" tabindex=\"0\" role=\"button\"><span class=\"su-spoiler-icon\"><\/span><h3>7. Notification of decisions to IPSG<\/h3><\/div><div class=\"su-spoiler-content su-u-clearfix su-u-trim\">\n<p>The written decisions of the CCF shall be provided to IPSG within one month from the date on which they were made (<a href=\"https:\/\/europeancourt.org\/en\/documents\/interpol\/commission-control-files\/statute\/#article-41\" title=\"Article 41(1) of the Statute of the Commission for the Control of INTERPOL\u2019s Files\">Article 41(1) of the Statute<\/a>). The CCF may decide on any appropriate corrective actions to ensure compliance with rules. To decide on other appropriate remedies, the CCF shall take into consideration the position of the Organization (<a href=\"https:\/\/europeancourt.org\/en\/documents\/interpol\/commission-control-files\/statute\/#article-39\" title=\"Article 39 of the Statute of the Commission for the Control of INTERPOL\u2019s Files\">Article 39 of the Statute<\/a>).<\/p>\n<\/div><\/div>\n<div class=\"su-spoiler su-spoiler-style-default su-spoiler-icon-plus h-toaccordion includetocloseall u-indent-1 su-spoiler-closed\" data-anchor=\"section-i-8\" data-scroll-offset=\"50\" data-anchor-in-url=\"yes\"><div class=\"su-spoiler-title\" tabindex=\"0\" role=\"button\"><span class=\"su-spoiler-icon\"><\/span><h3>8. Implementation of the CCF decisions<\/h3><\/div><div class=\"su-spoiler-content su-u-clearfix su-u-trim\">\n<p>In case the CCF decides that the information connected with a request shall be updated, corrected or deleted, IPSG shall implement the decision within one month from the date on which it was received unless it seeks further clarifications needed for the implementation of the decision.<\/p>\n<\/div><\/div>\n<div class=\"su-spoiler su-spoiler-style-default su-spoiler-icon-plus h-toaccordion includetocloseall u-indent-1 su-spoiler-closed\" data-anchor=\"section-i-9\" data-scroll-offset=\"50\" data-anchor-in-url=\"yes\"><div class=\"su-spoiler-title\" tabindex=\"0\" role=\"button\"><span class=\"su-spoiler-icon\"><\/span><h3>9. Notification of decisions to the parties<\/h3><\/div><div class=\"su-spoiler-content su-u-clearfix su-u-trim\">\n<p>The CCF shall provide applicants with its written and reasoned decisions no later than one month from the date on which the Commission either adopted its decisions or received notification of implementation by IPSG of corrective actions decided by the CCF (<a href=\"https:\/\/europeancourt.org\/en\/documents\/interpol\/commission-control-files\/statute\/#article-41\" title=\"Article 41 of the Statute of the Commission for the Control of INTERPOL\u2019s Files\">Article 41 of the Statute<\/a>).<\/p>\n<\/div><\/div>\n<div class=\"su-spoiler su-spoiler-style-default su-spoiler-icon-plus h-toaccordion includetocloseall u-indent-1 su-spoiler-closed\" data-anchor=\"section-i-10\" data-scroll-offset=\"50\" data-anchor-in-url=\"yes\"><div class=\"su-spoiler-title\" tabindex=\"0\" role=\"button\"><span class=\"su-spoiler-icon\"><\/span><h3>10. Applications for revision<\/h3><\/div><div class=\"su-spoiler-content su-u-clearfix su-u-trim\">\n<p>To apply for the revision of a CCF decision, it is indispensable to provide a precise but brief statement of each fact that has been newly discovered since the Commission\u2019s decision, and to indicate how these facts could have impacted the decision of the Commission and when such facts were discovered (as per <a href=\"https:\/\/europeancourt.org\/en\/documents\/interpol\/commission-control-files\/statute\/#article-42\" title=\"Article 42 of the Statute of the Commission for the Control of INTERPOL\u2019s Files\">Article 42 of the Statute of the Commission for the Control of INTERPOL\u2019s Files<\/a>).<\/p>\n<\/div><\/div>\n<h2 class=\"ec-structural-heading u-text-center\" id=\"section-ii\">II. Additional Information<\/h2>\n<div class=\"su-spoiler su-spoiler-style-default su-spoiler-icon-plus h-toaccordion includetocloseall u-indent-1 su-spoiler-closed\" data-anchor=\"section-ii-11\" data-scroll-offset=\"50\" data-anchor-in-url=\"yes\"><div class=\"su-spoiler-title\" tabindex=\"0\" role=\"button\"><span class=\"su-spoiler-icon\"><\/span><h3>11. Languages<\/h3><\/div><div class=\"su-spoiler-content su-u-clearfix su-u-trim\">\n<p>The CCF will only take into consideration legible documents provided in one of INTERPOL\u2019s working languages: Arabic, English, French or Spanish (<a href=\"https:\/\/europeancourt.org\/en\/documents\/interpol\/commission-control-files\/statute\/#article-18\" title=\"Article 18(1) of the Statute of the Commission for the Control of INTERPOL\u2019s Files\">Article 18(1) of the Statute<\/a>). As the working language selected by the CCF is English (<a href=\"https:\/\/europeancourt.org\/en\/documents\/interpol\/commission-control-files\/statute\/#article-18\" title=\"Article 18(2) of the Statute of the Commission for the Control of INTERPOL\u2019s Files\">Article 18(2) of the Statute<\/a>), its decisions are drafted in English only.<\/p>\n<\/div><\/div>\n<div class=\"su-spoiler su-spoiler-style-default su-spoiler-icon-plus h-toaccordion includetocloseall u-indent-1 su-spoiler-closed\" data-anchor=\"section-ii-12\" data-scroll-offset=\"50\" data-anchor-in-url=\"yes\"><div class=\"su-spoiler-title\" tabindex=\"0\" role=\"button\"><span class=\"su-spoiler-icon\"><\/span><h3>12. Written submissions and hearings<\/h3><\/div><div class=\"su-spoiler-content su-u-clearfix su-u-trim\">\n<p><a href=\"https:\/\/europeancourt.org\/en\/documents\/interpol\/commission-control-files\/statute\/#article-36\" title=\"Article 36 of the Statute of the Commission for the Control of INTERPOL\u2019s Files\">Article 36 of the Statute<\/a> provides that the CCF examines requests on the basis of written submissions sent via the CCF Portal, and hearings may only be held if deemed necessary by the CCF.<\/p>\n<\/div><\/div>\n<div class=\"su-spoiler su-spoiler-style-default su-spoiler-icon-plus h-toaccordion includetocloseall u-indent-1 su-spoiler-closed\" data-anchor=\"section-ii-13\" data-scroll-offset=\"50\" data-anchor-in-url=\"yes\"><div class=\"su-spoiler-title\" tabindex=\"0\" role=\"button\"><span class=\"su-spoiler-icon\"><\/span><h3>13. Single representative<\/h3><\/div><div class=\"su-spoiler-content su-u-clearfix su-u-trim\">\n<p>In case of several representatives, an applicant shall indicate which one will be the sole point of contact with the CCF. The CCF will issue its correspondence to only one addressee. Any additional mandated representatives may only submit information to the Commission on behalf of an applicant via the designated sole point of contact.<\/p>\n<\/div><\/div>\n<div class=\"su-spoiler su-spoiler-style-default su-spoiler-icon-plus h-toaccordion includetocloseall u-indent-1 su-spoiler-closed\" data-anchor=\"section-ii-14\" data-scroll-offset=\"50\" data-anchor-in-url=\"yes\"><div class=\"su-spoiler-title\" tabindex=\"0\" role=\"button\"><span class=\"su-spoiler-icon\"><\/span><h3>14. Limits of the CCF role<\/h3><\/div><div class=\"su-spoiler-content su-u-clearfix su-u-trim\">\n<p>The Commission\u2019s powers are limited to the data processed in the IIS and the examination of their compliance with INTERPOL\u2019s rules. It is not empowered to act with regard to national files, determine whether an applicant might travel abroad without fear of being arrested, intervene into national extradition proceedings or in relation to bilateral judicial cooperation between sovereign States, lead investigations, weigh evidence, make a determination on the merits of a case, provide assistance with visa applications or applications for permanent residence. Only the competent national authorities may do so.<\/p>\n<\/div><\/div>\n<div class=\"su-spoiler su-spoiler-style-default su-spoiler-icon-plus h-toaccordion includetocloseall u-indent-1 su-spoiler-closed\" data-anchor=\"section-ii-15\" data-scroll-offset=\"50\" data-anchor-in-url=\"yes\"><div class=\"su-spoiler-title\" tabindex=\"0\" role=\"button\"><span class=\"su-spoiler-icon\"><\/span><h3>15. Confidentiality<\/h3><\/div><div class=\"su-spoiler-content su-u-clearfix su-u-trim\">\n<p>Pursuant to <a href=\"https:\/\/europeancourt.org\/en\/documents\/interpol\/commission-control-files\/statute\/#article-20\" title=\"Article 20 of the Statute of the Commission for the Control of INTERPOL\u2019s Files\">Article 20 of its Statute<\/a>, the work and the files of the CCF are confidential. Requests are not recorded in the IIS. In that context, the letters of the Commission and its decisions are not intended for public dissemination. However, they can be used within the limits of what is necessary to defend the individual\u2019s rights, for instance in a court hearing.<\/p>\n<\/div><\/div>\n<div class=\"su-spoiler su-spoiler-style-default su-spoiler-icon-plus h-toaccordion includetocloseall u-indent-1 su-spoiler-closed\" data-anchor=\"section-ii-16\" data-scroll-offset=\"50\" data-anchor-in-url=\"yes\"><div class=\"su-spoiler-title\" tabindex=\"0\" role=\"button\"><span class=\"su-spoiler-icon\"><\/span><h3>16. Free submission of requests<\/h3><\/div><div class=\"su-spoiler-content su-u-clearfix su-u-trim\">\n<p>There shall be no charge for the submission of a request (<a href=\"https:\/\/europeancourt.org\/en\/documents\/interpol\/commission-control-files\/statute\/#article-30\" title=\"Article 30(3) of the Statute of the Commission for the Control of INTERPOL\u2019s Files\">Article 30(3) of the Statute of the Commission for the Control of INTERPOL\u2019s Files<\/a>). Accordingly, the Commission does not collect any fee as part of its activities concerning the processing of requests to access to or challenge information recorded in the IIS.<\/p>\n<\/div><\/div>\n<div class=\"su-spoiler su-spoiler-style-default su-spoiler-icon-plus h-toaccordion includetocloseall u-indent-1 su-spoiler-closed\" data-anchor=\"section-ii-17\" data-scroll-offset=\"50\" data-anchor-in-url=\"yes\"><div class=\"su-spoiler-title\" tabindex=\"0\" role=\"button\"><span class=\"su-spoiler-icon\"><\/span><h3>17.
