\r\n

Los Estados miembros del Consejo de Europa, signatarios del presente Protocolo al Convenio para la protecci\u00f3n de los Derechos Humanos y de las Libertades Fundamentales<\/a>, firmado en Roma el 4 de noviembre de 1950 (denominado en adelante \u00abel Convenio\u00bb),<\/p>\r\n

Considerando que los avances realizados en varios Estados miembros del Consejo de Europa expresan una tendencia general en favor de la abolici\u00f3n de la pena de muerte,<\/p>\r\n

Han convenido lo siguiente:<\/p><\/div><\/div>\r\n

Art\u00edculo 1
\r\nAbolici\u00f3n de la pena de muerte<\/h2><\/div>
\r\n

Queda abolida la pena de muerte. Nadie podr\u00e1 ser condenado a tal pena ni ejecutado.<\/p><\/div><\/div>\r\n

<\/span>

Art\u00edculo 2
\r\nPena de muerte en tiempo de guerra<\/h2><\/div>
\r\n

Un Estado podr\u00e1 prever en su legislaci\u00f3n la pena de muerte para aquellos actos cometidos en tiempo de guerra o de peligro inminente de guerra; dicha pena solamente se aplicar\u00e1 en los casos previstos por dicha legislaci\u00f3n y con acuerdo a lo dispuesto en la misma. Dicho Estado comunicar\u00e1 al Secretario General del Consejo de Europa las correspondientes disposiciones de la legislaci\u00f3n en cuesti\u00f3n.<\/p><\/div><\/div>\r\n

Art\u00edculo 3
\r\nProhibici\u00f3n de derogaciones<\/h2><\/div>
\r\n

No se autorizar\u00e1 ninguna derogaci\u00f3n de las disposiciones del presente Protocolo en aplicaci\u00f3n del art\u00edculo 15 del Convenio<\/a>.<\/p><\/div><\/div>\r\n

Art\u00edculo 4
\r\nProhibici\u00f3n de reservas<\/h2><\/div>
\r\n

No se aceptar\u00e1 ninguna reserva a las disposiciones del presente Protocolo en virtud del art\u00edculo 57 del Convenio<\/a>.<\/p><\/div><\/div>\r\n

Art\u00edculo 5
\r\nAplicaci\u00f3n territorial<\/h2><\/div>
\r\n

1. Todo Estado podr\u00e1, en el momento de la firma o en el momento del dep\u00f3sito de su instrumento de ratificaci\u00f3n, aceptaci\u00f3n o aprobaci\u00f3n, designar el o los territorios a los cuales se aplicar\u00e1 el presente Protocolo.<\/p>\r\n

2. Todo Estado podr\u00e1, en cualquier otro momento posterior y mediante una declaraci\u00f3n dirigida al Secretario General del Consejo de Europa, ampliar la aplicaci\u00f3n del presente Protocolo a cualquier otro territorio designado en la declaraci\u00f3n. El Protocolo entrar\u00e1 en vigor, con respecto a dicho territorio, el primer d\u00eda del mes siguiente a la fecha de recepci\u00f3n de la notificaci\u00f3n por el Secretario General.<\/p>\r\n

3. Toda declaraci\u00f3n formulada en virtud de los p\u00e1rrafos anteriores podr\u00e1 retirarse, respecto a cualquier territorio designado en la misma, mediante notificaci\u00f3n dirigida al Secretario General. La retirada tendr\u00e1 efecto el primer d\u00eda del mes siguiente a la fecha de recepci\u00f3n de la notificaci\u00f3n por el Secretario General.<\/p><\/div><\/div>\r\n

\r\nRelaci\u00f3n con el Convenio<\/h2><\/div>

Art\u00edculo 7
\r\nFirma y ratificaci\u00f3n<\/h2><\/div>
\r\n

El presente Protocolo estar\u00e1 abierto a la firma de los Estados miembros del Consejo de Europa, signatarios del Convenio<\/a>. Ser\u00e1 objeto de ratificaci\u00f3n, aceptaci\u00f3n o aprobaci\u00f3n. Un Estado miembro del Consejo de Europa no podr\u00e1 ratificar, aceptar o aprobar el presente Protocolo sin haber ratificado el Convenio simult\u00e1nea o anteriormente. Los instrumentos de ratificaci\u00f3n, aceptaci\u00f3n o aprobaci\u00f3n se depositar\u00e1n ante el Secretario General del Consejo de Europa.<\/p><\/div><\/div>\r\n

Art\u00edculo 8
\r\nEntrada en vigor<\/h2><\/div>
\r\n

1. El presente Protocolo entrar\u00e1 en vigor el primer d\u00eda del mes siguiente a la fecha en la cual cinco Estados miembros del Consejo de Europa hayan manifestado su consentimiento en quedar vinculados por el Protocolo de conformidad con lo dispuesto en el art\u00edculo 7.<\/p>\r\n

2. Para cualquier Estado miembro que manifieste posteriormente su consentimiento de quedar vinculado por el Protocolo, \u00e9ste entrar\u00e1 en vigor el primer d\u00eda del mes siguiente a la fecha del dep\u00f3sito del instrumento de ratificaci\u00f3n, aceptaci\u00f3n o aprobaci\u00f3n.<\/p><\/div><\/div>\r\n

Art\u00edculo 9
\r\nFunciones del depositario<\/h2><\/div>
\r\n

El Secretario General del Consejo de Europa notificar\u00e1 a los Estados miembros del Consejo:<\/p>\r\n

a) toda firma;<\/p>\r\n

b) el dep\u00f3sito de todo instrumento de ratificaci\u00f3n, aceptaci\u00f3n o de aprobaci\u00f3n;<\/p>\r\n

c) toda fecha de entrada en vigor del presente Protocolo, de conformidad con lo dispuesto en los art\u00edculos 5 y 8;<\/p>\r\n

d) cualquier otro acto, notificaci\u00f3n o comunicaci\u00f3n referente al presente Protocolo.<\/p>\r\n

En fe de lo cual, los abajo firmantes, debidamente autorizados para ello, han firmado el presente Protocolo.<\/p>\r\n

Hecho en Estrasburgo el 28 de abril de 1983 en franc\u00e9s<\/a> y en ingl\u00e9s<\/a>, siendo ambos textos igualmente aut\u00e9nticos, en un s\u00f3lo ejemplar que se depositar\u00e1 en los archivos del Consejo de Europa.
