Pentru o cerere preventiv\u0103 nu este necesar ca statul s\u0103 fi ob\u021binut deja o noti\u021b\u0103 ro\u0219ie sau o difuziune: argumentele pot fi prezentate \u00een prealabil, \u00een fapt, \u00eempotriva unei viitoare \u00eencerc\u0103ri a statului solicitant de a folosi Interpol, dac\u0103 exist\u0103 motive s\u0103 se considere c\u0103 acesta ar putea \u00eencerca s\u0103 fac\u0103 acest lucru.<\/div>\n<div class=\"ec-flow-item\">Temeiurile tipice pentru obiec\u021biile prealabile sunt acelea\u0219i ca \u00een cazul contest\u0103rii unei noti\u021be ro\u0219ii sau a unei difuziuni deja publicate:<\/div>\n<ul>\n<li>folosirea cauzei penale \u00een scopul persecut\u0103rii din motive politice, religioase, rasiale sau similare, din cauza originii, apartenen\u021bei la un grup persecutat, opiniilor exprimate, activit\u0103\u021bii jurnalistice, activit\u0103\u021bii de ap\u0103rare a drepturilor omului, activit\u0103\u021bii civice sau altei activit\u0103\u021bi publice;<\/li>\n<li>\u00eencercarea de a ob\u021bine o urm\u0103rire interna\u021bional\u0103 nu pentru o infrac\u021biune de drept comun, ci pentru fapte legate de serviciul militar, de un conflict armat sau de ac\u021biunile uneia dintre p\u0103r\u021bile la conflict;<\/li>\n<li>un risc real de tortur\u0103, de tratamente sau pedepse inumane ori degradante sau de denegare flagrant\u0103 de dreptate \u00een cazul extr\u0103d\u0103rii c\u0103tre statul solicitant;<\/li>\n<li>inexisten\u021ba, anularea sau modificarea hot\u0103r\u00e2rii na\u021bionale pe care se \u00eentemeiaz\u0103 cererea de dare \u00een urm\u0103rire; \u00eencetarea cauzei; \u00eemplinirea termenului de prescrip\u021bie; neconcordan\u021ba dintre descrierea acuza\u021biei sau a rolului dumneavoastr\u0103 \u0219i materialele cauzei; situa\u021bia \u00een care statul solicitant a avut o posibilitate real\u0103 de a solicita extr\u0103darea, dar, f\u0103r\u0103 o explica\u021bie rezonabil\u0103, nu a f\u0103cut acest lucru.<\/li>\n<\/ul>\n<div class=\"ec-flow-item\">Pot stabili numai pe baza documentelor c\u00e2t timp va fi necesar \u00een cazul dumneavoastr\u0103 \u0219i, prin urmare, c\u00e2t va costa preg\u0103tirea obiec\u021biilor prealabile. Acest timp este necesar pentru examinarea documentelor, identificarea faptelor esen\u021biale, analiza practicii CCF, a CEDO \u0219i a altor organisme interna\u021bionale \u00een raport cu fiecare temei, preg\u0103tirea argumentelor \u0219i expunerea tuturor acestora \u00een cerere \u00eentr-o form\u0103 concis\u0103, clar\u0103 \u0219i coerent\u0103.<\/div>\n<div class=\"ec-flow-item\">De regul\u0103, r\u0103spund \u00een termen de o s\u0103pt\u0103m\u00e2n\u0103 de la primirea tuturor documentelor \u0219i informa\u021biilor necesare. Dac\u0103 nu rezult\u0103 temeiuri rezonabile pentru o cerere adresat\u0103 CCF, v\u0103 voi comunica doar acest lucru.
