Tieto opatrenia zohr\u00e1vaj\u00fa z\u00e1sadn\u00fa \u00falohu pri predch\u00e1dzan\u00ed nezvratn\u00fdm situ\u00e1ci\u00e1m, ktor\u00e9 by vn\u00fatro\u0161t\u00e1tnym s\u00fadom a\/alebo S\u00fadu br\u00e1nili riadne presk\u00fama\u0165 s\u0165a\u017enosti pod\u013ea Dohovoru a pod\u013ea okolnost\u00ed zabezpe\u010di\u0165 s\u0165a\u017eovate\u013eovi praktick\u00e9 a \u00fa\u010dinn\u00e9 vyu\u017eitie pr\u00e1v pod\u013ea Dohovoru, ktor\u00fdch sa dovol\u00e1va.<\/p>\n<p>Ak \u017ealovan\u00e1 zmluvn\u00e1 strana nespln\u00ed predbe\u017en\u00e9 opatrenia, nar\u00fa\u0161a t\u00fdm \u00fa\u010dinnos\u0165 pr\u00e1va na individu\u00e1lnu s\u0165a\u017enos\u0165 zaru\u010den\u00e9ho \u010dl\u00e1nkom <a href=\"https:\/\/europeancourt.org\/sk\/dokumenty\/rada-eur%c3%b3py\/eur%c3%b3psky-dohovor-o-%c4%beudsk%c3%bdch-pr%c3%a1vach\/#article-34\" title=\"Article 34 - Eur\u00f3psky dohovor o \u013eudsk\u00fdch pr\u00e1vach\">34<\/a> Eur\u00f3pskeho dohovoru o \u013eudsk\u00fdch pr\u00e1vach a form\u00e1lny z\u00e1v\u00e4zok \u0161t\u00e1tu pod\u013ea <a href=\"https:\/\/europeancourt.org\/sk\/dokumenty\/rada-eur%c3%b3py\/eur%c3%b3psky-dohovor-o-%c4%beudsk%c3%bdch-pr%c3%a1vach\/#article-1\" title=\"Article 1 - Eur\u00f3psky dohovor o \u013eudsk\u00fdch pr\u00e1vach\">\u010dl\u00e1nku 1 c<\/a>hr\u00e1ni\u0165 pr\u00e1va a slobody uveden\u00e9 v Dohovore. Pri naria\u010fovan\u00ed predbe\u017en\u00fdch opatren\u00ed S\u00fad vykon\u00e1va svoju pr\u00e1vomoc zabezpe\u010di\u0165 plnenie z\u00e1v\u00e4zkov prijat\u00fdch Vysok\u00fdmi zmluvn\u00fdmi stranami v Dohovore a jeho Protokoloch v s\u00falade s <a href=\"https:\/\/europeancourt.org\/sk\/dokumenty\/rada-eur%c3%b3py\/eur%c3%b3psky-dohovor-o-%c4%beudsk%c3%bdch-pr%c3%a1vach\/#article-19\" title=\"Article 19 - Eur\u00f3psky dohovor o \u013eudsk\u00fdch pr\u00e1vach\">\u010dl\u00e1nkom 19<\/a>, pri\u010dom t\u00e1to pr\u00e1vomoc zah\u0155\u0148a v\u0161etky ot\u00e1zky t\u00fdkaj\u00face sa ich v\u00fdkladu a uplat\u0148ovania, ako stanovuje \u010dl\u00e1nok <a href=\"https:\/\/europeancourt.org\/sk\/dokumenty\/rada-eur%c3%b3py\/eur%c3%b3psky-dohovor-o-%c4%beudsk%c3%bdch-pr%c3%a1vach\/#article-32\" title=\"Article 32 - Eur\u00f3psky dohovor o \u013eudsk\u00fdch pr\u00e1vach\">32<\/a> Dohovoru (pozri okrem in\u00e9ho Mamatkulov a Askarov proti Turecku [VK], \u010d. 46827\/99 a 46951\/99, \u00a7\u00a7 128\u2013129, ES\u013dP 2005-I; Paladi proti Moldavsku [VK], \u010d. 39806\/05, \u00a7\u00a7 84\u2013106, 10. marca 2009; M.K. a ostatn\u00ed proti Po\u013esku, \u010d. 40503\/17 a 2 \u010fal\u0161ie, \u00a7\u00a7 229\u2013238, 23. j\u00fala 2020; a K.I. proti Franc\u00fazsku, \u010d. 5560\/19, \u00a7 115, 15. apr\u00edla 2021). Predbe\u017en\u00e9 opatrenia s\u00fa teda z\u00e1v\u00e4zn\u00e9.<\/p>\n<p>Znenie pravidla 39 bolo 23. febru\u00e1ra 2024 zmenen\u00e9 tak, aby \u010falej objasnilo okolnosti, za ktor\u00fdch mo\u017eno nariadi\u0165 predbe\u017en\u00e9 opatrenia, ako aj prah, ktor\u00fd treba dosiahnu\u0165 v s\u00favislosti so \u017eiados\u0165ou o ne a ich uplat\u0148ovan\u00edm. Cie\u013eom zmeny bolo z\u00e1rove\u0148 zos\u00faladi\u0165 znenie pravidla s ust\u00e1lenou judikat\u00farou a praxou S\u00fadu v oblasti predbe\u017en\u00fdch opatren\u00ed.<\/p>\n<p>Cie\u013eom t\u00fdchto revidovan\u00fdch Praktick\u00fdch pokynov je poskytn\u00fa\u0165 podrobn\u00e9 usmernenie k hmotnopr\u00e1vnym a procesn\u00fdm aspektom konania S\u00fadu o predbe\u017en\u00fdch opatreniach pod\u013ea pravidla 39 Rokovacieho poriadku S\u00fadu, aby bolo jasnej\u0161ie a transparentnej\u0161ie, ako sa ved\u00fa konania t\u00fdkaj\u00face sa predbe\u017en\u00fdch opatren\u00ed, za ak\u00fdch v\u00fdnimo\u010dn\u00fdch okolnost\u00ed mo\u017eno tak\u00e9to opatrenia nariadi\u0165 a kedy ich mo\u017eno op\u00e4tovne pos\u00fadi\u0165. S\u00fa ur\u010den\u00e9 (potenci\u00e1lnym) s\u0165a\u017eovate\u013eom, ich z\u00e1stupcom, zmluvn\u00fdm stran\u00e1m a vo v\u0161eobecnosti zainteresovan\u00fdm subjektom.<\/p>\n<\/div><\/div>\n<h2 class=\"su-spoiler-title ec-fake-spoiler-heading\" id=\"ii\">II. Rozsah a fungovanie konania o predbe\u017en\u00fdch opatreniach<\/h2>\n<div class=\"su-spoiler su-spoiler-style-default su-spoiler-icon-plus h-toaccordion includetocloseall ec-visual-indent-2 su-spoiler-closed\" data-anchor=\"ii-a\" data-scroll-offset=\"50\" data-anchor-in-url=\"yes\"><div class=\"su-spoiler-title\" tabindex=\"0\" role=\"button\"><span class=\"su-spoiler-icon\"><\/span><h3>A. Rozsah pravidla 39 Rokovacieho poriadku S\u00fadu<\/h3><\/div><div class=\"su-spoiler-content su-u-clearfix su-u-trim\">\n<p>Ak S\u00fad nariadi predbe\u017en\u00e9 opatrenie, \u010do rob\u00ed vo v\u00fdnimo\u010dn\u00fdch pr\u00edpadoch, jeho cie\u013eom je poskytn\u00fa\u0165 ochranu pred bezprostredn\u00fdm nebezpe\u010denstvom nenapravite\u013enej ujmy. S\u00fad preto stran\u00e1m konania ulo\u017e\u00ed povinnos\u0165 vykona\u0165 tak\u00e9to opatrenie len vtedy, ak po presk\u00faman\u00ed v\u0161etk\u00fdch dostupn\u00fdch inform\u00e1ci\u00ed us\u00fadi, \u017ee opatrenie je potrebn\u00e9 v z\u00e1ujme str\u00e1n alebo riadneho vedenia konania. Predbe\u017en\u00e9 opatrenia nariaden\u00e9 S\u00fadom m\u00f4\u017eu stran\u00e1m uklada\u0165 povinnos\u0165 zdr\u017ea\u0165 sa ur\u010dit\u00fdch \u00fakonov alebo im prik\u00e1za\u0165, aby prijali konkr\u00e9tne opatrenia.<\/p>\n<p>Novo kodifikovan\u00e9 znenie pravidla 39 vych\u00e1dza z toho, \u017ee predbe\u017en\u00e9 opatrenia sa uplat\u0148uj\u00fa v pr\u00edpadoch \u201ebezprostredn\u00e9ho nebezpe\u010denstva nenapravite\u013enej ujmy na pr\u00e1ve pod\u013ea Dohovoru\u201c. Pojem \u201enenapravite\u013en\u00e1 ujma na pr\u00e1ve pod\u013ea Dohovoru\u201c bol vymedzen\u00fd ako ujma, ktor\u00fa vzh\u013eadom na jej povahu nemo\u017eno napravi\u0165, odstr\u00e1ni\u0165 uveden\u00edm do p\u00f4vodn\u00e9ho stavu ani primerane nahradi\u0165. V tejto s\u00favislosti treba pojem \u201eobnovenie\u201c ch\u00e1pa\u0165 ako n\u00e1vrat do stavu pred sp\u00f4soben\u00edm akejko\u013evek ujmy. S\u00fad teda naria\u010fuje predbe\u017en\u00e9 opatrenia vtedy, ke\u010f existuje nebezpe\u010denstvo, \u017ee bez nich by vznikla situ\u00e1cia, v ktorej by restitutio in integrum ani in\u00e9 formy n\u00e1pravy neboli mo\u017en\u00e9, ak by ich S\u00fad na konci konania pred n\u00edm pova\u017eoval za opodstatnen\u00e9. Na to, aby sa pravidlo 39 mohlo uplatni\u0165, musia preto okolnosti pr\u00edpadu prekro\u010di\u0165 vysok\u00fd prah z\u00e1va\u017enosti. Predbe\u017en\u00e9 opatrenia sa naria\u010fuj\u00fa iba vtedy, ak existuj\u00fa prima facie d\u00f4kazy o bezprostrednom nebezpe\u010denstve nenapravite\u013enej ujmy; nesta\u010d\u00ed, \u017ee by s\u0165a\u017eovatelia bez predbe\u017en\u00fdch opatren\u00ed iba zn\u00e1\u0161ali \u0165a\u017ekosti. Pokia\u013e ide o vy\u010derpanie vn\u00fatro\u0161t\u00e1tnych opravn\u00fdch prostriedkov, pozri \u010das\u0165 <a href=\"#iii-c\" title=\"C. Vn\u00fatro\u0161t\u00e1tne opravn\u00e9 prostriedky s odkladn\u00fdm \u00fa\u010dinkom\">III.C<\/a> ni\u017e\u0161ie.<\/p>\n<p>S\u00fad teda z\u00e1sadne naria\u010fuje predbe\u017en\u00e9 opatrenia iba vo v\u00fdnimo\u010dn\u00fdch pr\u00edpadoch a po d\u00f4kladnom presk\u00faman\u00ed v\u0161etk\u00fdch relevantn\u00fdch okolnost\u00ed. Vo v\u00e4\u010d\u0161ine tak\u00fdchto pr\u00edpadov dostupn\u00e9 d\u00f4kazy poukazuj\u00fa na jasne h\u00e1jite\u013en\u00e9 tvrdenie o skuto\u010dnom ohrozen\u00ed \u017eivota a zdravia a na z toho vypl\u00fdvaj\u00face re\u00e1lne nebezpe\u010denstvo v\u00e1\u017enej ujmy v rozpore so z\u00e1kladn\u00fdmi ustanoveniami Dohovoru.<\/p>\n<\/div><\/div>\n<div class=\"su-spoiler su-spoiler-style-default su-spoiler-icon-plus h-toaccordion includetocloseall ec-visual-indent-2 su-spoiler-closed\" data-anchor=\"ii-b\" data-scroll-offset=\"50\" data-anchor-in-url=\"yes\"><div class=\"su-spoiler-title\" tabindex=\"0\" role=\"button\"><span class=\"su-spoiler-icon\"><\/span><h3>B. Org\u00e1ny rozhoduj\u00face v konan\u00ed pod\u013ea pravidla 39<\/h3><\/div><div class=\"su-spoiler-content su-u-clearfix su-u-trim\">\n<p>Pr\u00e1vomoc S\u00fadu rozhodova\u0165 o \u017eiadostiach o predbe\u017en\u00e9 opatrenia vykon\u00e1vaj\u00fa slu\u017ebukonaj\u00faci sudcovia alebo pod\u013ea okolnost\u00ed predseda sekcie, komora, predseda ve\u013ekej komory, ve\u013ek\u00e1 komora alebo predseda S\u00fadu (pravidlo 39 ods. 2).<\/p>\n<p>Slu\u017ebukonaj\u00facimi sudcami s\u00fa sudcovia zvolen\u00ed za podpredsedov piatich sekci\u00ed pod\u013ea pravidla 8 ods. 1 a 2. Predseda S\u00fadu ich vymen\u00fava v s\u00falade s pravidlom 39 ods. 5, aby rozhodovali o \u017eiadostiach o predbe\u017en\u00e9 opatrenia. Od roku 2022 vykon\u00e1vaj\u00fa funkciu slu\u017ebukonaj\u00facich sudcov v\u0161etci piati podpredsedovia sekci\u00ed. Pod\u013ea zau\u017e\u00edvanej praxe slu\u017ebukonaj\u00faci sudcovia nepresk\u00famavaj\u00fa \u017eiadosti o predbe\u017en\u00e9 opatrenia proti zmluvnej strane, za ktor\u00fa bol pr\u00edslu\u0161n\u00fd sudca zvolen\u00fd alebo ktorej je \u0161t\u00e1tnym pr\u00edslu\u0161n\u00edkom.<\/p>\n<p>V zmenenom znen\u00ed pravidla 39 sa pl\u00e9num S\u00fadu rozhodlo zavies\u0165 osobitn\u00fd pr\u00e1vny z\u00e1klad umo\u017e\u0148uj\u00faci predsedovi S\u00fadu v pr\u00edpade potreby nariadi\u0165 predbe\u017en\u00e9 opatrenia.<\/p>\n<p>\u017diadosti o predbe\u017en\u00e9 opatrenia v nov\u00fdch individu\u00e1lnych s\u0165a\u017enostiach presk\u00famavaj\u00fa predov\u0161etk\u00fdm slu\u017ebukonaj\u00faci sudcovia za pomoci \u0161pecializovanej jednotky Kancel\u00e1rie S\u00fadu. Slu\u017ebukonaj\u00faci sudcovia maj\u00fa na\u010falej mo\u017enos\u0165 post\u00fapi\u0165 \u017eiados\u0165 o predbe\u017en\u00e9 opatrenia niektor\u00e9mu z \u010fal\u0161\u00edch rozhodovac\u00edch org\u00e1nov uveden\u00fdch v pravidle 39 ods. 2 vr\u00e1tane kolegi\u00e1lnych org\u00e1nov. Tak\u00e9to post\u00fapenie m\u00f4\u017ee nasta\u0165 v r\u00f4znych situ\u00e1ci\u00e1ch; z\u00e1vis\u00ed od povahy \u017eiadosti, veci, v ktorej sa pod\u00e1va, a od miery naliehavosti. Pr\u00e1ve miera naliehavosti m\u00f4\u017ee znamena\u0165, \u017ee post\u00fapenie kolegi\u00e1lnemu org\u00e1nu nie je mo\u017en\u00e9, tak\u017ee slu\u017ebukonaj\u00faci sudca m\u00f4\u017ee pravidlo 39 uplatni\u0165 do\u010dasne, okrem in\u00e9ho s cie\u013eom umo\u017eni\u0165 n\u00e1sledn\u00e9 presk\u00famanie \u017eiadosti o predbe\u017en\u00e9 opatrenie t\u00fdmto org\u00e1nom. O tom, \u010di \u017eiados\u0165 presk\u00fama kolegi\u00e1lny org\u00e1n, rozhoduje samotn\u00fd S\u00fad.<\/p>\n<p>\u017diadosti o predbe\u017en\u00e9 opatrenia podan\u00e9 v medzi\u0161t\u00e1tnych s\u0165a\u017enostiach, v individu\u00e1lnych s\u0165a\u017enostiach prejedn\u00e1van\u00fdch ve\u013ekou komorou a v ozn\u00e1men\u00fdch individu\u00e1lnych s\u0165a\u017enostiach, ktor\u00e9 u\u017e boli pridelen\u00e9 sekci\u00e1m, spravidla presk\u00famavaj\u00fa predseda S\u00fadu, predseda ve\u013ekej komory alebo predsedovia sekci\u00ed. Mo\u017enos\u0165 post\u00fapenia kolegi\u00e1lnemu org\u00e1nu sa uplatn\u00ed aj vtedy, ke\u010f rozhodovacia pr\u00e1vomoc patr\u00ed v prvom stupni predsedovi S\u00fadu, predsedovi ve\u013ekej komory alebo predsedom sekci\u00ed.<\/p>\n<\/div><\/div>\n<div class=\"su-spoiler su-spoiler-style-default su-spoiler-icon-plus h-toaccordion includetocloseall ec-visual-indent-2 su-spoiler-closed\" data-anchor=\"ii-c\" data-scroll-offset=\"50\" data-anchor-in-url=\"yes\"><div class=\"su-spoiler-title\" tabindex=\"0\" role=\"button\"><span class=\"su-spoiler-icon\"><\/span><h3>C. Rozhodovac\u00ed postup pri \u017eiadostiach o predbe\u017en\u00e9 opatrenia<\/h3><\/div><div class=\"su-spoiler-content su-u-clearfix su-u-trim\">\n<p>Po presk\u00faman\u00ed rozhodovacieho procesu pod\u013ea pravidla 39, ktor\u00e9 pl\u00e9num S\u00fadu uskuto\u010dnilo v roku 2023, sa v\u0161etky rozhodnutia S\u00fadu t\u00fdkaj\u00face sa predbe\u017en\u00fdch opatren\u00ed bez oh\u013eadu na povahu prijat\u00e9ho rozhodnutia (napr\u00edklad nariadenie predbe\u017en\u00fdch opatren\u00ed, zamietnutie \u017eiadost\u00ed, odro\u010denie presk\u00famania \u017eiadost\u00ed alebo zru\u0161enie existuj\u00facich predbe\u017en\u00fdch opatren\u00ed) oznamuj\u00fa stran\u00e1m vo forme rozhodnutia podp\u00edsan\u00e9ho pod\u013ea okolnost\u00ed slu\u017ebukonaj\u00facim sudcom, predsedom sekcie, predsedom ve\u013ekej komory alebo predsedom S\u00fadu. Men\u00e1 sudcov, ktor\u00ed prij\u00edmaj\u00fa rozhodnutia v konan\u00ed o predbe\u017en\u00fdch opatreniach, sa v rozhodnutiach uv\u00e1dzaj\u00fa systematicky.<\/p>\n<p>K rozhodnutiam sa priklad\u00e1 list Kancel\u00e1rie, ktor\u00fd obsahuje inform\u00e1cie o konan\u00ed, ako aj pr\u00edpadn\u00e9 pokyny alebo \u017eiadosti adresovan\u00e9 stran\u00e1m.<\/p>\n<p>S\u0165a\u017eovatelia s\u00fa informovan\u00ed o rozhodnutiach S\u00fadu t\u00fdkaj\u00facich sa \u017eiadost\u00ed o predbe\u017en\u00e9 opatrenia prostredn\u00edctvom ECHR Rule 39 Site, faxom alebo po\u0161tou.<\/p>\n<p>S\u00fad m\u00f4\u017ee nariadi\u0165 predbe\u017en\u00e9 opatrenia do odvolania, na dobu trvania konania pred S\u00fadom alebo na obmedzen\u00e9 \u010dasov\u00e9 obdobie, pod\u013ea okolnost\u00ed pr\u00edpadu.<\/p>\n<p>Ak s\u00fa predbe\u017en\u00e9 opatrenia nariaden\u00e9 na obmedzen\u00e9 \u010dasov\u00e9 obdobie, m\u00f4\u017ee sa tak sta\u0165 z r\u00f4znych d\u00f4vodov: napr\u00edklad na obdobie do doru\u010denia relevantn\u00fdch inform\u00e1ci\u00ed od str\u00e1n na \u017eiados\u0165 S\u00fadu; s cie\u013eom umo\u017eni\u0165 vn\u00fatro\u0161t\u00e1tnym s\u00fadom, aby v prebiehaj\u00facich konaniach v plnom rozsahu pos\u00fadili ot\u00e1zku, ktor\u00e1 je predmetom \u017eiadosti o predbe\u017en\u00e9 opatrenie; preto\u017ee sa pova\u017euje za potrebn\u00e9, aby \u017eiados\u0165 presk\u00famal kolegi\u00e1lny org\u00e1n, a na zvolanie zasadnutia je potrebn\u00fd \u010fal\u0161\u00ed \u010das; alebo preto, \u017ee slu\u017ebukonaj\u00faci sudca sa domnieva, \u017ee pred vydan\u00edm rozhodnutia je potrebn\u00fd \u010fal\u0161\u00ed \u010das.<\/p>\n<p>Ak S\u00fad po\u017eiadal o \u010fal\u0161ie inform\u00e1cie, obe strany s\u00fa pod\u013ea pravidla 54 ods. 2 p\u00edsm. a) Rokovacieho poriadku S\u00fadu vyzvan\u00e9, aby v stanovenej lehote poskytli potrebn\u00e9 inform\u00e1cie. D\u013a\u017eka tejto lehoty z\u00e1vis\u00ed od okolnost\u00ed pr\u00edpadu a naliehavosti \u017eiadosti. V tak\u00fdchto pr\u00edpadoch m\u00f4\u017ee S\u00fad po doru\u010den\u00ed inform\u00e1ci\u00ed od str\u00e1n rozhodn\u00fa\u0165, \u017ee platn\u00e9 predbe\u017en\u00e9 opatrenie pred\u013a\u017ei, nepred\u013a\u017ei alebo zru\u0161\u00ed.<\/p>\n<p>S\u00fad m\u00f4\u017ee tie\u017e rozhodn\u00fa\u0165, \u017ee presk\u00famanie \u017eiadost\u00ed o predbe\u017en\u00e9 opatrenia odro\u010d\u00ed a vyzve strany, aby poskytli inform\u00e1cie, ak to stupe\u0148 naliehavosti umo\u017e\u0148uje. Ide o pr\u00edpady, ke\u010f inform\u00e1cie, ktor\u00e9 s\u0165a\u017eovatelia mohli S\u00fadu predlo\u017ei\u0165, neposta\u010duj\u00fa na presk\u00famanie \u017eiadosti a ke\u010f sa pova\u017euje za mo\u017en\u00e9 vy\u017eiada\u0165 si inform\u00e1cie od \u017ealovanej zmluvnej strany pred prijat\u00edm ak\u00e9hoko\u013evek rozhodnutia.<\/p>\n<p>Ak sa presk\u00famanie \u017eiadosti odro\u010d\u00ed, \u017ealovan\u00e1 zmluvn\u00e1 strana alebo obe strany s\u00fa pod\u013ea pravidla 54 ods. 2 p\u00edsm. a) vyzvan\u00e9, aby v stanovenej lehote poskytli potrebn\u00e9 inform\u00e1cie. D\u013a\u017eka tejto lehoty z\u00e1vis\u00ed od okolnost\u00ed pr\u00edpadu a stup\u0148a naliehavosti \u017eiadosti. Po doru\u010den\u00ed inform\u00e1ci\u00ed od str\u00e1n m\u00f4\u017ee S\u00fad bu\u010f op\u00e4tovne odro\u010di\u0165 presk\u00famanie \u017eiadosti a polo\u017ei\u0165 stran\u00e1m \u010fal\u0161ie ot\u00e1zky, alebo vyda\u0165 rozhodnutie o \u017eiadosti o predbe\u017en\u00e9 opatrenia.<\/p>\n<p>S\u00fad m\u00f4\u017ee tie\u017e pod\u013ea pravidla 39 ods. 3 Rokovacieho poriadku S\u00fadu rozhodn\u00fa\u0165, \u017ee predbe\u017en\u00e9 opatrenie ozn\u00e1mi V\u00fdboru ministrov, ak s\u00fadny org\u00e1n, ktor\u00fd ho prijal, pova\u017euje tak\u00e9to ozn\u00e1menie za od\u00f4vodnen\u00e9. Za t\u00fdchto okolnost\u00ed s\u00fa strany o ozn\u00e1men\u00ed informovan\u00e9.<\/p>\n<p>Ak \u017ealovan\u00e1 zmluvn\u00e1 strana \u00fadajne nesplnila predbe\u017en\u00e9 opatrenie a S\u00fad rozhodne o ozn\u00e1men\u00ed s\u0165a\u017enosti alebo jej \u010dasti \u017ealovanej zmluvnej strane, V\u00fdbor ministrov m\u00f4\u017ee by\u0165 informovan\u00fd aj o akejko\u013evek ot\u00e1zke nastolenej v s\u00favislosti s dodr\u017eiavan\u00edm povinnost\u00ed pod\u013ea \u010dl\u00e1nku <a href=\"https:\/\/europeancourt.org\/sk\/dokumenty\/rada-eur%c3%b3py\/eur%c3%b3psky-dohovor-o-%c4%beudsk%c3%bdch-pr%c3%a1vach\/#article-34\" title=\"Article 34 - Eur\u00f3psky dohovor o \u013eudsk\u00fdch pr\u00e1vach\">34<\/a> Dohovoru.<\/p>\n<p>Obe strany s\u00fa povinn\u00e9 plne spolupracova\u0165 pri veden\u00ed konania a najm\u00e4 vykona\u0165 tak\u00e9 \u00fakony, ktor\u00e9 s\u00fa v ich moci a ktor\u00e9 S\u00fad pova\u017euje za potrebn\u00e9 na riadny v\u00fdkon spravodlivosti (pozri pravidlo 44A). V pr\u00edpade s\u0165a\u017eovate\u013eov to znamen\u00e1 povinnos\u0165 zabezpe\u010di\u0165, aby boli \u017eiadosti o predbe\u017en\u00e9 opatrenia podan\u00e9 v\u010das a aby obsahovali v\u0161etky potrebn\u00e9 inform\u00e1cie a dokumenty (pozri odseky 32 a\u017e 37 ni\u017e\u0161ie). Je z\u00e1sadn\u00e9, aby s\u0165a\u017eovatelia neodkladali podanie \u017eiadosti s cie\u013eom vytvori\u0165 vy\u0161\u0161\u00ed stupe\u0148 naliehavosti. Tak\u00e9to odklady m\u00f4\u017eu nepriaznivo ovplyvni\u0165 pr\u00e1va a z\u00e1ujmy s\u0165a\u017eovate\u013eov, ako aj schopnos\u0165 S\u00fadu \u00fa\u010dinne vybavova\u0165 \u017eiadosti o predbe\u017en\u00e9 opatrenia. S\u00fad zd\u00f4raz\u0148uje, \u017ee zmluvn\u00e9 strany maj\u00fa v\u017edy mo\u017enos\u0165 vopred upozorni\u0165 S\u00fad, ak sa domnievaj\u00fa, \u017ee mo\u017eno bezprostredne o\u010dak\u00e1va\u0165 podanie \u017eiadosti pod\u013ea pravidla 39, a pri takom upozornen\u00ed poskytn\u00fa\u0165 ak\u00e9ko\u013evek relevantn\u00e9 inform\u00e1cie.<\/p>\n<p>Ako sa uv\u00e1dza v odseku 13 vy\u0161\u0161ie, rozhodnutia S\u00fadu o \u017eiadostiach o predbe\u017en\u00e9 opatrenia sa stran\u00e1m oznamuj\u00fa vo forme rozhodnutia podp\u00edsan\u00e9ho s\u00fadnym org\u00e1nom, ktor\u00fd ho prijal. Tento s\u00fadny org\u00e1n m\u00f4\u017ee pod\u013ea vlastn\u00e9ho uv\u00e1\u017eenia poskytn\u00fa\u0165 \u010fal\u0161ie od\u00f4vodnenie rozhodnutia.<\/p>\n<p>Proti \u017eiadnemu rozhodnutiu t\u00fdkaj\u00facemu sa \u017eiadost\u00ed o predbe\u017en\u00e9 opatrenia nie je pr\u00edpustn\u00e9 odvolanie.<\/p>\n<p>\u017dalovan\u00e1 zmluvn\u00e1 strana v\u0161ak m\u00f4\u017ee po\u017eiada\u0165 S\u00fad, aby op\u00e4tovne pos\u00fadil svoje rozhodnutie nariadi\u0165 predbe\u017en\u00e9 opatrenia, ak sa domnieva, \u017ee opatrenia u\u017e nie s\u00fa potrebn\u00e9, alebo ak m\u00e1 inform\u00e1cie, ktor\u00e9 v relevantnom \u010dase neboli dostupn\u00e9 alebo neboli S\u00fadu v\u010das spr\u00edstupnen\u00e9. Na podanie tak\u00fdchto \u017eiadost\u00ed nie je stanoven\u00e1 pevn\u00e1 lehota. Po doru\u010den\u00ed \u017eiadosti o op\u00e4tovn\u00e9 pos\u00fadenie mo\u017eno druh\u00fa stranu vyzva\u0165, aby v stanovenej lehote predlo\u017eila vyjadrenie. S\u00fad n\u00e1sledne presk\u00fama podania str\u00e1n a rozhodne o \u017eiadosti o op\u00e4tovn\u00e9 pos\u00fadenie na z\u00e1klade v\u0161etk\u00fdch aktualizovan\u00fdch a relevantn\u00fdch skutkov\u00fdch a pr\u00e1vnych inform\u00e1ci\u00ed.<\/p>\n<p>V pr\u00edpade zmeny okolnost\u00ed m\u00f4\u017eu s\u0165a\u017eovatelia poda\u0165 nov\u00fa \u017eiados\u0165 o predbe\u017en\u00e9 opatrenia, ak p\u00f4vodnej \u017eiadosti nebolo vyhoven\u00e9.<\/p>\n<p>Opatrenie pod\u013ea pravidla 39 m\u00f4\u017ee S\u00fad svoj\u00edm rozhodnut\u00edm kedyko\u013evek zru\u0161i\u0165. Ke\u010f\u017ee nariadenie pod\u013ea pravidla 39 je spojen\u00e9 s konan\u00edm pred S\u00fadom, opatrenie bude zru\u0161en\u00e9 najm\u00e4 vtedy, ak sa v s\u0165a\u017enosti nepokra\u010duje.<\/p>\n<p>Ak je to opodstatnen\u00e9, S\u00fad m\u00f4\u017ee s\u00fa\u010dasne so zamietnut\u00edm \u017eiadosti o predbe\u017en\u00e9 opatrenia rozhodn\u00fa\u0165, \u017ee s\u0165a\u017enos\u0165 vyhl\u00e1si za neprijate\u013en\u00fa.<\/p>\n<p>V s\u00falade s prioritnou politikou S\u00fadu patria s\u0165a\u017enosti, v ktor\u00fdch boli nariaden\u00e9 predbe\u017en\u00e9 opatrenia, do kateg\u00f3rie \u201eNaliehav\u00e9 s\u0165a\u017enosti\u201c (kateg\u00f3ria I).
