Kur cakton masa t\u00eb p\u00ebrkohshme, Gjykata ushtron juridiksionin e saj p\u00ebr t\u00eb siguruar respektimin e zotimeve t\u00eb nd\u00ebrmarra nga Pal\u00ebt e Larta Kontraktuese n\u00eb Konvent\u00eb dhe n\u00eb Protokollet e saj, n\u00eb p\u00ebrputhje me Nenin <a href=\"https:\/\/europeancourt.org\/sq\/dokumentet\/k%c3%abshilli-i-evrop%c3%abs\/konventa-evropiane-p%c3%abr-t%c3%ab-drejtat-e-njeriut\/#article-19\" title=\"Article 19 - Konventa Evropiane p\u00ebr t\u00eb Drejtat e Njeriut\">19<\/a>, juridiksion i cili shtrihet n\u00eb t\u00eb gjitha \u00e7\u00ebshtjet lidhur me interpretimin dhe zbatimin e tyre, si\u00e7 parashikohet n\u00eb Nenin <a href=\"https:\/\/europeancourt.org\/sq\/dokumentet\/k%c3%abshilli-i-evrop%c3%abs\/konventa-evropiane-p%c3%abr-t%c3%ab-drejtat-e-njeriut\/#article-32\" title=\"Article 32 - Konventa Evropiane p\u00ebr t\u00eb Drejtat e Njeriut\">32<\/a> t\u00eb Konvent\u00ebs (shih, nd\u00ebr t\u00eb tjera, Mamatkulov dhe Askarov k. Turqis\u00eb [DhM], nr. 46827\/99 dhe 46951\/99, \u00a7\u00a7 128\u201329, GJEDNJ 2005-I; Paladi k. Moldavis\u00eb [DhM], nr. 39806\/05, \u00a7\u00a7 84\u2013106, 10 mars 2009; M.K. dhe t\u00eb tjer\u00eb k. Polonis\u00eb, nr. 40503\/17 dhe 2 t\u00eb tjera, \u00a7\u00a7 229\u201338, 23 korrik 2020; dhe K.I. k. Franc\u00ebs, nr. 5560\/19, \u00a7 115, 15 prill 2021). Masat e p\u00ebrkohshme jan\u00eb, pra, detyruese.<\/p>\n<p>Teksti i Nenit 39 u ndryshua m\u00eb 23 shkurt 2024 p\u00ebr t\u00eb sqaruar m\u00eb tej rrethanat n\u00eb t\u00eb cilat mund t\u00eb caktohen masat e p\u00ebrkohshme dhe pragun q\u00eb duhet t\u00eb arrihet n\u00eb lidhje me k\u00ebrkes\u00ebn p\u00ebr to dhe zbatimin e tyre. Ndryshimi synonte gjithashtu ta p\u00ebrafronte tekstin e Nenit me praktik\u00ebn gjyq\u00ebsore dhe praktik\u00ebn e konsoliduar t\u00eb Gjykat\u00ebs lidhur me masat e p\u00ebrkohshme.<\/p>\n<p>K\u00ebto Udh\u00ebzime praktike t\u00eb rishikuara kan\u00eb p\u00ebr q\u00ebllim t\u00eb japin udh\u00ebzime t\u00eb holl\u00ebsishme p\u00ebr aspektet materiale dhe procedurale t\u00eb procedur\u00ebs s\u00eb masave t\u00eb p\u00ebrkohshme t\u00eb Gjykat\u00ebs sipas Nenit 39 t\u00eb Rregullave t\u00eb Gjykat\u00ebs. Kjo synon t\u00eb sjell\u00eb m\u00eb shum\u00eb qart\u00ebsi dhe transparenc\u00eb n\u00eb zhvillimin e procedurave q\u00eb lidhen me masat e p\u00ebrkohshme, n\u00eb rrethanat p\u00ebrjashtimore n\u00eb t\u00eb cilat mund t\u00eb caktohen masa t\u00eb tilla dhe n\u00eb rastet kur ato mund t\u00eb rishqyrtohen. Udh\u00ebzimet u drejtohen ankuesve (potencial\u00eb), p\u00ebrfaq\u00ebsuesve t\u00eb tyre, Pal\u00ebve Kontraktuese dhe, n\u00eb p\u00ebrgjith\u00ebsi, aktor\u00ebve t\u00eb interesuar.<\/p>\n<\/div><\/div>\n<h2 class=\"su-spoiler-title ec-fake-spoiler-heading\" id=\"ii\">II. Fush\u00ebveprimi dhe funksionimi i procedur\u00ebs s\u00eb masave t\u00eb p\u00ebrkohshme<\/h2>\n<div class=\"su-spoiler su-spoiler-style-default su-spoiler-icon-plus h-toaccordion includetocloseall ec-visual-indent-2 su-spoiler-closed\" data-anchor=\"ii-a\" data-scroll-offset=\"50\" data-anchor-in-url=\"yes\"><div class=\"su-spoiler-title\" tabindex=\"0\" role=\"button\"><span class=\"su-spoiler-icon\"><\/span><h3>A. Fush\u00ebveprimi i Nenit 39 t\u00eb Rregullave t\u00eb Gjykat\u00ebs<\/h3><\/div><div class=\"su-spoiler-content su-u-clearfix su-u-trim\">\n<p>Kur Gjykata cakton nj\u00eb mas\u00eb t\u00eb p\u00ebrkohshme, gj\u00eb q\u00eb e b\u00ebn n\u00eb rrethana p\u00ebrjashtimore, ajo synon t\u00eb ofroj\u00eb mbrojtje nga nj\u00eb rrezik i menj\u00ebhersh\u00ebm p\u00ebr d\u00ebm t\u00eb pariparuesh\u00ebm. Prandaj Gjykata i urdh\u00ebron pal\u00ebt n\u00eb procedur\u00eb t\u00eb zbatojn\u00eb nj\u00eb mas\u00eb t\u00eb till\u00eb vet\u00ebm n\u00ebse, pasi ka shqyrtuar t\u00eb gjith\u00eb informacionin n\u00eb dispozicion, \u00e7mon se masa \u00ebsht\u00eb e nevojshme n\u00eb interes t\u00eb pal\u00ebve ose t\u00eb zhvillimit t\u00eb rregullt t\u00eb procedur\u00ebs. Masat e p\u00ebrkohshme t\u00eb caktuara nga Gjykata mund t\u2019u k\u00ebrkojn\u00eb pal\u00ebve t\u00eb p\u00ebrmbahen nga kryerja e veprimeve t\u00eb caktuara ose t\u2019i urdh\u00ebrojn\u00eb ato t\u00eb nd\u00ebrmarrin masa specifike.<\/p>\n<p>Versioni i kodifikuar rishtazi i Nenit 39 parashikon se masat e p\u00ebrkohshme zbatohen n\u00eb rastet e \u00abrrezikut t\u00eb menj\u00ebhersh\u00ebm p\u00ebr d\u00ebm t\u00eb pariparuesh\u00ebm ndaj nj\u00eb t\u00eb drejte t\u00eb mbrojtur nga Konventa\u00bb. Nocioni i \u00abd\u00ebmit t\u00eb pariparuesh\u00ebm ndaj nj\u00eb t\u00eb drejte t\u00eb mbrojtur nga Konventa\u00bb \u00ebsht\u00eb p\u00ebrkufizuar si d\u00ebm q\u00eb, p\u00ebr shkak t\u00eb natyr\u00ebs s\u00eb tij, nuk do t\u00eb mund t\u00eb riparohej, t\u00eb rivendosej ose t\u00eb kompensohej n\u00eb m\u00ebnyr\u00eb adekuate. N\u00eb k\u00ebt\u00eb kontekst, termi \u00abrivendosje\u00bb duhet t\u00eb kuptohet si kthim n\u00eb gjendjen p\u00ebrpara se t\u00eb ishte shkaktuar d\u00ebmi. Prandaj, Gjykata cakton masa t\u00eb p\u00ebrkohshme kur ekziston rreziku q\u00eb mungesa e tyre t\u00eb \u00e7oj\u00eb n\u00eb nj\u00eb situat\u00eb n\u00eb t\u00eb cil\u00ebn restitutio in integrum ose forma t\u00eb tjera t\u00eb riparimit, q\u00eb Gjykata n\u00eb p\u00ebrfundim t\u00eb procedur\u00ebs para saj mund t\u2019i \u00e7monte t\u00eb nevojshme, nuk do t\u00eb ishin m\u00eb t\u00eb mundshme. Rrethanat e \u00e7\u00ebshtjes duhet, rrjedhimisht, t\u00eb tejkalojn\u00eb nj\u00eb prag t\u00eb lart\u00eb serioziteti q\u00eb Neni 39 t\u00eb vihet n\u00eb zbatim. Masat e p\u00ebrkohshme caktohen vet\u00ebm kur ekzistojn\u00eb prova prima facie p\u00ebr nj\u00eb rrezik t\u00eb menj\u00ebhersh\u00ebm p\u00ebr d\u00ebm t\u00eb pariparuesh\u00ebm, dhe jo kur ankuesit thjesht do t\u00eb p\u00ebrballeshin me v\u00ebshtir\u00ebsi n\u00eb munges\u00eb t\u00eb masave t\u00eb p\u00ebrkohshme. Sa i p\u00ebrket shterimit t\u00eb mjeteve juridike t\u00eb brendshme, shihni pjes\u00ebn <a href=\"#iii-c\" title=\"C. Mjetet juridike t\u00eb brendshme me efekt pezullues\">III.C<\/a> m\u00eb posht\u00eb.<\/p>\n<p>K\u00ebshtu, Gjykata cakton masa t\u00eb p\u00ebrkohshme, si \u00e7\u00ebshtje parimi, vet\u00ebm n\u00eb raste p\u00ebrjashtimore dhe mbi baz\u00ebn e nj\u00eb shqyrtimi rigoroz t\u00eb t\u00eb gjitha rrethanave p\u00ebrkat\u00ebse. N\u00eb shumic\u00ebn e k\u00ebtyre rasteve, provat e disponueshme tregojn\u00eb se ekziston nj\u00eb baz\u00eb qartazi e argumentueshme p\u00ebr nj\u00eb k\u00ebrc\u00ebnim t\u00eb v\u00ebrtet\u00eb ndaj jet\u00ebs dhe integritetit fizik, me rrezikun real pasues p\u00ebr d\u00ebm t\u00eb r\u00ebnd\u00eb n\u00eb shkelje t\u00eb dispozitave thelb\u00ebsore t\u00eb Konvent\u00ebs.<\/p>\n<\/div><\/div>\n<div class=\"su-spoiler su-spoiler-style-default su-spoiler-icon-plus h-toaccordion includetocloseall ec-visual-indent-2 su-spoiler-closed\" data-anchor=\"ii-b\" data-scroll-offset=\"50\" data-anchor-in-url=\"yes\"><div class=\"su-spoiler-title\" tabindex=\"0\" role=\"button\"><span class=\"su-spoiler-icon\"><\/span><h3>B. Organet vendimmarr\u00ebse n\u00eb procedur\u00ebn e Nenit 39<\/h3><\/div><div class=\"su-spoiler-content su-u-clearfix su-u-trim\">\n<p>Kompetenca e Gjykat\u00ebs p\u00ebr t\u00eb vendosur mbi k\u00ebrkesat p\u00ebr masa t\u00eb p\u00ebrkohshme ushtrohet nga gjyqtar\u00ebt e sh\u00ebrbimit ose, sipas rastit, nga Kryetari i Seksionit, Dhoma, Kryetari i Dhom\u00ebs s\u00eb Madhe, Dhoma e Madhe ose Kryetari i Gjykat\u00ebs (Neni 39 \u00a7 2).<\/p>\n<p>Gjyqtar\u00ebt e sh\u00ebrbimit jan\u00eb gjyqtar\u00ebt e zgjedhur si Z\u00ebvend\u00ebskryetar\u00eb t\u00eb pes\u00eb Seksioneve n\u00eb p\u00ebrputhje me Nenin 8 \u00a7\u00a7 1 dhe 2. Ata em\u00ebrohen nga Kryetari i Gjykat\u00ebs n\u00eb p\u00ebrputhje me Nenin 39 \u00a7 5 p\u00ebr t\u00eb vendosur mbi k\u00ebrkesat p\u00ebr masa t\u00eb p\u00ebrkohshme. Prej vitit 2022, t\u00eb pes\u00eb Z\u00ebvend\u00ebskryetar\u00ebt e Seksioneve sh\u00ebrbejn\u00eb si gjyqtar\u00eb t\u00eb sh\u00ebrbimit. N\u00eb praktik\u00eb, gjyqtar\u00ebt e sh\u00ebrbimit nuk shqyrtojn\u00eb k\u00ebrkesa p\u00ebr masa t\u00eb p\u00ebrkohshme kund\u00ebr Pal\u00ebs Kontraktuese p\u00ebr t\u00eb cil\u00ebn \u00ebsht\u00eb zgjedhur gjyqtari p\u00ebrkat\u00ebs ose shtetas i s\u00eb cil\u00ebs \u00ebsht\u00eb ai.<\/p>\n<p>N\u00eb versionin e ndryshuar t\u00eb Nenit 39, Gjykata plenare vendosi t\u00eb fus\u00eb nj\u00eb baz\u00eb ligjore t\u00eb posa\u00e7me q\u00eb i lejon Kryetarit t\u00eb Gjykat\u00ebs, kur \u00ebsht\u00eb e nevojshme, t\u00eb caktoj\u00eb masa t\u00eb p\u00ebrkohshme.<\/p>\n<p>K\u00ebrkesat p\u00ebr masa t\u00eb p\u00ebrkohshme t\u00eb paraqitura n\u00eb kuad\u00ebr t\u00eb ankimeve t\u00eb reja individuale shqyrtohen kryesisht nga gjyqtar\u00ebt e sh\u00ebrbimit, me ndihm\u00ebn e nj\u00eb nj\u00ebsie t\u00eb specializuar brenda Sekretaris\u00eb s\u00eb Gjykat\u00ebs. Gjyqtar\u00ebt e sh\u00ebrbimit mund t\u2019ia referojn\u00eb nj\u00eb k\u00ebrkes\u00eb p\u00ebr masa t\u00eb p\u00ebrkohshme nj\u00ebrit prej autoriteteve t\u00eb tjera vendimmarr\u00ebse t\u00eb renditura n\u00eb Nenin 39 \u00a7 2, p\u00ebrfshir\u00eb organet kolegjiale. Referimet mund t\u00eb b\u00ebhen n\u00eb situata t\u00eb ndryshme dhe varen nga natyra e k\u00ebrkes\u00ebs, nga \u00e7\u00ebshtja n\u00eb kuad\u00ebr t\u00eb s\u00eb cil\u00ebs b\u00ebhet k\u00ebrkesa dhe nga shkalla e urgjenc\u00ebs. Vendimi p\u00ebr shqyrtimin e nj\u00eb k\u00ebrkese nga nj\u00eb organ kolegjial i takon vet\u00eb Gjykat\u00ebs.<\/p>\n<p>K\u00ebrkesat p\u00ebr masa t\u00eb p\u00ebrkohshme t\u00eb paraqitura n\u00eb kuad\u00ebr t\u00eb ankimeve nd\u00ebrshtet\u00ebrore, t\u00eb ankimeve individuale q\u00eb jan\u00eb n\u00eb pritje para Dhom\u00ebs s\u00eb Madhe dhe t\u00eb ankimeve individuale t\u00eb komunikuara q\u00eb tashm\u00eb u jan\u00eb caktuar Seksioneve, n\u00eb parim shqyrtohen nga Kryetari i Gjykat\u00ebs, Kryetari i Dhom\u00ebs s\u00eb Madhe ose Kryetar\u00ebt e Seksioneve. Procesi vendimmarr\u00ebs lidhur me k\u00ebrkesat p\u00ebr masa t\u00eb p\u00ebrkohshme<\/h3><\/div><div class=\"su-spoiler-content su-u-clearfix su-u-trim\">\n<p>Pas rishikimit t\u00eb procesit vendimmarr\u00ebs sipas Nenit 39 nga Gjykata plenare n\u00eb vitin 2023, pavar\u00ebsisht nga natyra e vendimit t\u00eb marr\u00eb (p\u00ebr shembull, caktimi i masave t\u00eb p\u00ebrkohshme, refuzimi i k\u00ebrkesave, shtyrja e shqyrtimit t\u00eb k\u00ebrkesave ose heqja e masave t\u00eb p\u00ebrkohshme ekzistuese), t\u00eb gjitha vendimet e Gjykat\u00ebs lidhur me masat e p\u00ebrkohshme u njoftohen pal\u00ebve n\u00eb form\u00ebn e nj\u00eb vendimi t\u00eb n\u00ebnshkruar nga gjyqtari i sh\u00ebrbimit, Kryetari i Seksionit, Kryetari i Dhom\u00ebs s\u00eb Madhe ose Kryetari i Gjykat\u00ebs, sipas rastit. Emrat e gjyqtar\u00ebve q\u00eb marrin vendime n\u00eb procedur\u00ebn p\u00ebr masat e p\u00ebrkohshme tregohen sistematikisht n\u00eb vendime.<\/p>\n<p>Vendimet shoq\u00ebrohen me nj\u00eb let\u00ebr nga Sekretaria, e cila p\u00ebrfshin informacion lidhur me procedur\u00ebn, si dhe \u00e7do udh\u00ebzim drejtuar pal\u00ebve ose \u00e7do k\u00ebrkes\u00eb drejtuar atyre.<\/p>\n<p>Ankuesit informohen p\u00ebr vendimet e Gjykat\u00ebs lidhur me k\u00ebrkesat p\u00ebr masa t\u00eb p\u00ebrkohshme n\u00ebp\u00ebrmjet ECHR Rule 39 Site, me faks ose me post\u00eb.<\/p>\n<p>Gjykata mund t\u00eb caktoj\u00eb masa t\u00eb p\u00ebrkohshme deri n\u00eb njoftim t\u00eb m\u00ebtejsh\u00ebm, p\u00ebr koh\u00ebzgjatjen e procedur\u00ebs para Gjykat\u00ebs ose p\u00ebr nj\u00eb periudh\u00eb t\u00eb kufizuar kohore, n\u00eb var\u00ebsi t\u00eb rrethanave t\u00eb \u00e7\u00ebshtjes.<\/p>\n<p>Kur masat e p\u00ebrkohshme jepen p\u00ebr nj\u00eb periudh\u00eb t\u00eb kufizuar kohore, kjo b\u00ebhet p\u00ebr arsye t\u00eb ndryshme, si p\u00ebr shembull: n\u00eb pritje t\u00eb marrjes s\u00eb informacionit p\u00ebrkat\u00ebs nga pal\u00ebt me k\u00ebrkes\u00eb t\u00eb Gjykat\u00ebs; p\u00ebr t\u2019u mund\u00ebsuar gjykatave vendase t\u00eb shqyrtojn\u00eb plot\u00ebsisht, n\u00eb procedurat n\u00eb zhvillim, \u00e7\u00ebshtjen q\u00eb \u00ebsht\u00eb objekt i k\u00ebrkes\u00ebs p\u00ebr mas\u00eb t\u00eb p\u00ebrkohshme; sepse vler\u00ebsohet se nj\u00eb k\u00ebrkes\u00eb duhet t\u00eb shqyrtohet nga nj\u00eb organ kolegjial dhe nevojitet m\u00eb shum\u00eb koh\u00eb p\u00ebr t\u00eb planifikuar nj\u00eb mbledhje; ose sepse gjyqtari i sh\u00ebrbimit \u00e7mon se nevojitet m\u00eb shum\u00eb koh\u00eb p\u00ebrpara dh\u00ebnies s\u00eb vendimit.<\/p>\n<p>Kur Gjykata ka k\u00ebrkuar m\u00eb shum\u00eb informacion, t\u00eb dyja pal\u00ebt ftohen, sipas Nenit 54 \u00a7 2 (a) t\u00eb Rregullave t\u00eb Gjykat\u00ebs, t\u00eb japin informacionin e nevojsh\u00ebm brenda nj\u00eb periudhe t\u00eb caktuar kohore. Koh\u00ebzgjatja e periudh\u00ebs n\u00eb fjal\u00eb varet nga rrethanat e \u00e7\u00ebshtjes dhe urgjenca e k\u00ebrkes\u00ebs. N\u00eb raste t\u00eb tilla, pas marrjes s\u00eb informacionit nga pal\u00ebt, Gjykata mund t\u00eb vendos\u00eb zgjatjen, moszgjatjen ose heqjen e \u00e7do mase t\u00eb p\u00ebrkohshme n\u00eb fuqi.<\/p>\n<p>Gjykata mund t\u00eb vendos\u00eb gjithashtu t\u00eb shtyj\u00eb shqyrtimin e k\u00ebrkesave p\u00ebr masa t\u00eb p\u00ebrkohshme dhe t\u2019i ftoj\u00eb pal\u00ebt t\u00eb japin informacion, kur shkalla e urgjenc\u00ebs e lejon k\u00ebt\u00eb, n\u00eb rastet kur informacioni q\u00eb ankuesit kan\u00eb mundur t\u2019i paraqesin Gjykat\u00ebs nuk \u00ebsht\u00eb i mjaftuesh\u00ebm p\u00ebr t\u2019i mund\u00ebsuar asaj t\u00eb shqyrtoj\u00eb k\u00ebrkes\u00ebn dhe kur vler\u00ebsohet e mundur t\u00eb k\u00ebrkohet informacion nga Pala Kontraktuese e paditur p\u00ebrpara se t\u00eb merret ndonj\u00eb vendim.<\/p>\n<p>Kur shqyrtimi i k\u00ebrkes\u00ebs shtyhet, Pala Kontraktuese e paditur ose t\u00eb dyja pal\u00ebt ftohen, sipas Nenit 54 \u00a7 2 (a), t\u00eb japin informacionin e nevojsh\u00ebm brenda nj\u00eb periudhe t\u00eb caktuar kohore. Koh\u00ebzgjatja e periudh\u00ebs n\u00eb fjal\u00eb varet nga rrethanat e \u00e7\u00ebshtjes dhe shkalla e urgjenc\u00ebs s\u00eb k\u00ebrkes\u00ebs. Pas marrjes s\u00eb informacionit nga pal\u00ebt, Gjykata mund ose ta shtyj\u00eb s\u00ebrish shqyrtimin e k\u00ebrkes\u00ebs dhe t\u2019u parashtroj\u00eb pal\u00ebve pyetje t\u00eb tjera, ose t\u00eb jap\u00eb vendimin e saj mbi k\u00ebrkes\u00ebn p\u00ebr masa t\u00eb p\u00ebrkohshme.<\/p>\n<p>Gjykata mund t\u00eb vendos\u00eb gjithashtu t\u00eb njoftoj\u00eb Komitetin e Ministrave p\u00ebr caktimin e nj\u00eb mase t\u00eb p\u00ebrkohshme, sipas Nenit 39 \u00a7 3 t\u00eb Rregullave t\u00eb Gjykat\u00ebs, kur organi gjyq\u00ebsor q\u00eb ka caktuar mas\u00ebn e p\u00ebrkohshme \u00e7mon se njoftimi \u00ebsht\u00eb i p\u00ebrligjur. N\u00eb k\u00ebto rrethana, pal\u00ebt vihen n\u00eb dijeni p\u00ebr k\u00ebt\u00eb njoftim.<\/p>\n<p>Kur pretendohet se nj\u00eb Pal\u00eb Kontraktuese e paditur nuk ka respektuar nj\u00eb mas\u00eb t\u00eb p\u00ebrkohshme dhe Gjykata vendos t\u2019ia komunikoj\u00eb ankimin ose nj\u00eb pjes\u00eb t\u00eb tij Pal\u00ebs Kontraktuese t\u00eb paditur, Komiteti i Ministrave mund t\u00eb njoftohet gjithashtu p\u00ebr \u00e7do \u00e7\u00ebshtje t\u00eb ngritur lidhur me respektimin e detyrimeve sipas Nenit <a href=\"https:\/\/europeancourt.org\/sq\/dokumentet\/k%c3%abshilli-i-evrop%c3%abs\/konventa-evropiane-p%c3%abr-t%c3%ab-drejtat-e-njeriut\/#article-34\" title=\"Article 34 - Konventa Evropiane p\u00ebr t\u00eb Drejtat e Njeriut\">34<\/a> t\u00eb Konvent\u00ebs.<\/p>\n<p>T\u00eb dyja pal\u00ebt kan\u00eb detyrimin t\u00eb bashk\u00ebpunojn\u00eb plot\u00ebsisht n\u00eb zhvillimin e procedur\u00ebs dhe, n\u00eb ve\u00e7anti, t\u00eb nd\u00ebrmarrin \u00e7do veprim brenda mund\u00ebsive t\u00eb tyre q\u00eb Gjykata e konsideron t\u00eb nevojsh\u00ebm p\u00ebr administrimin e rregullt t\u00eb drejt\u00ebsis\u00eb (shih Nenin 44A). Sa u p\u00ebrket ankuesve, kjo n\u00ebnkupton detyrimin p\u00ebr t\u00eb siguruar q\u00eb k\u00ebrkesat p\u00ebr masa t\u00eb p\u00ebrkohshme t\u00eb paraqiten n\u00eb koh\u00eb dhe t\u00eb p\u00ebrmbajn\u00eb t\u00eb gjith\u00eb informacionin dhe dokumentet e nevojshme (shih paragraf\u00ebt 32\u201337 m\u00eb posht\u00eb). \u00cbsht\u00eb thelb\u00ebsore q\u00eb ankuesit t\u00eb mos e vonojn\u00eb paraqitjen e k\u00ebrkes\u00ebs s\u00eb tyre p\u00ebr t\u00eb krijuar nj\u00eb shkall\u00eb m\u00eb t\u00eb lart\u00eb urgjence. Vonesa t\u00eb tilla mund t\u00eb ndikojn\u00eb negativisht n\u00eb t\u00eb drejtat dhe interesat e ankuesve dhe n\u00eb aft\u00ebsin\u00eb e Gjykat\u00ebs p\u00ebr t\u2019i trajtuar n\u00eb m\u00ebnyr\u00eb efektive k\u00ebrkesat p\u00ebr masa t\u00eb p\u00ebrkohshme. Sa u p\u00ebrket Pal\u00ebve Kontraktuese, n\u00eb shum\u00eb raste, ndon\u00ebse jo n\u00eb t\u00eb gjitha, shkalla e urgjenc\u00ebs mund t\u00eb jet\u00eb n\u00ebn kontrollin e tyre. Gjykata thekson se Pal\u00ebt Kontraktuese mund ta v\u00ebn\u00eb gjithmon\u00eb n\u00eb dijeni Gjykat\u00ebn paraprakisht kur \u00e7mojn\u00eb se nj\u00eb k\u00ebrkes\u00eb sipas Nenit 39 mund t\u00eb jet\u00eb e af\u00ebrt, duke dh\u00ebn\u00eb \u00e7do informacion p\u00ebrkat\u00ebs n\u00eb at\u00eb moment.<\/p>\n<p>Si\u00e7 shpjegohet n\u00eb paragrafin 13 m\u00eb sip\u00ebr, vendimet e Gjykat\u00ebs mbi k\u00ebrkesat p\u00ebr masa t\u00eb p\u00ebrkohshme u njoftohen pal\u00ebve n\u00eb form\u00ebn e nj\u00eb vendimi t\u00eb n\u00ebnshkruar nga organi gjyq\u00ebsor q\u00eb e ka marr\u00eb at\u00eb. Arsyetim i m\u00ebtejsh\u00ebm lidhur me vendimin mund t\u00eb jepet sipas diskrecionit t\u00eb atij organi gjyq\u00ebsor.<\/p>\n<p>Nuk lejohet ankim kund\u00ebr asnj\u00eb vendimi lidhur me k\u00ebrkesat p\u00ebr masa t\u00eb p\u00ebrkohshme.<\/p>\n<p>Megjithat\u00eb, nj\u00eb Pal\u00eb Kontraktuese e paditur mund t\u2019i k\u00ebrkoj\u00eb Gjykat\u00ebs t\u00eb rishqyrtoj\u00eb vendimin e saj p\u00ebr t\u00eb caktuar masa t\u00eb p\u00ebrkohshme, n\u00ebse \u00e7mon se masat nuk jan\u00eb m\u00eb t\u00eb nevojshme ose kur zot\u00ebron informacion q\u00eb nuk ishte i disponuesh\u00ebm n\u00eb koh\u00ebn p\u00ebrkat\u00ebse ose nuk i ishte v\u00ebn\u00eb Gjykat\u00ebs n\u00eb dispozicion n\u00eb koh\u00ebn e duhur. Nuk ka afat t\u00eb caktuar p\u00ebr paraqitjen e k\u00ebrkesave t\u00eb tilla. Kur merret nj\u00eb k\u00ebrkes\u00eb p\u00ebr rishqyrtim, mund t\u00eb k\u00ebrkohen komente nga pala tjet\u00ebr, t\u00eb cilat duhet t\u00eb paraqiten brenda nj\u00eb periudhe t\u00eb caktuar kohore. M\u00eb pas Gjykata shqyrton parashtresat e pal\u00ebve dhe jep vendimin e saj mbi k\u00ebrkes\u00ebn p\u00ebr rishqyrtim, mbi baz\u00ebn e \u00e7do informacioni faktik dhe juridik t\u00eb p\u00ebrdit\u00ebsuar e p\u00ebrkat\u00ebs.<\/p>\n<p>N\u00eb rast ndryshimi t\u00eb rrethanave, ankuesit mund t\u00eb paraqesin nj\u00eb k\u00ebrkes\u00eb t\u00eb re p\u00ebr masa t\u00eb p\u00ebrkohshme kur k\u00ebrkesa fillestare nuk \u00ebsht\u00eb pranuar.<\/p>\n<p>Nj\u00eb mas\u00eb sipas Nenit 39 mund t\u00eb hiqet n\u00eb \u00e7do koh\u00eb me vendim t\u00eb Gjykat\u00ebs. N\u00eb ve\u00e7anti, duke qen\u00eb se nj\u00eb urdh\u00ebr sipas Nenit 39 lidhet me procedur\u00ebn para Gjykat\u00ebs, masa do t\u00eb hiqet n\u00ebse ankimi nuk ndiqet m\u00eb.<\/p>\n<p>Kur \u00ebsht\u00eb e p\u00ebrligjur, Gjykata mund t\u00eb vendos\u00eb ta deklaroj\u00eb ankimin t\u00eb papranuesh\u00ebm n\u00eb t\u00eb nj\u00ebjt\u00ebn koh\u00eb me refuzimin e nj\u00eb k\u00ebrkese p\u00ebr masa t\u00eb p\u00ebrkohshme.<\/p>\n<p>N\u00eb p\u00ebrputhje me politik\u00ebn e p\u00ebrpar\u00ebsis\u00eb s\u00eb Gjykat\u00ebs, ankimet p\u00ebr t\u00eb cilat jan\u00eb caktuar masa t\u00eb p\u00ebrkohshme hyjn\u00eb n\u00eb kategorin\u00eb e \u00abAnkimeve urgjente\u00bb (kategoria I).
