Neni 39 i Rregullave t\u00eb Gjykat\u00ebs parashikon nj\u00eb p\u00ebrjashtim: gjat\u00eb shqyrtimit t\u00eb ankimit, GJEDNJ mund, edhe pa nj\u00eb p\u00ebrfundim t\u00eb till\u00eb, ta urdh\u00ebroj\u00eb shtetin e paditur t\u00eb kryej\u00eb veprime t\u00eb caktuara ose t\u00eb p\u00ebrmbahet nga kryerja e tyre, p\u00ebr t\u00eb parandaluar shkaktimin e nj\u00eb d\u00ebmi t\u00eb konsideruesh\u00ebm nga lista e ngusht\u00eb e m\u00ebposhtme.<\/div>\n<div class=\"ec-flow-item\">S\u00eb pari, b\u00ebhet fjal\u00eb p\u00ebr d\u00ebm q\u00eb mund t\u2019i shkaktohet nj\u00eb personi n\u00eb nj\u00eb shtet tjet\u00ebr, n\u00ebse shteti i paditur ka vendosur ta transferoj\u00eb atje: vdekje, d\u00ebm i r\u00ebnd\u00eb dhe i pakthyesh\u00ebm p\u00ebr sh\u00ebndetin ose tortur\u00eb, pavar\u00ebsisht n\u00ebse transferimi lidhet me ndjekje penale apo me vuajtje d\u00ebnimi. Kur kjo lidhje ekziston, k\u00ebtyre u shtohen d\u00ebnimet trupore mizore, burgimi i p\u00ebrjetsh\u00ebm pa mund\u00ebsi reale lirimi ose rishqyrtimi, heqja e zgjatur arbitrare e liris\u00eb ose mohimi flagrant i drejt\u00ebsis\u00eb.<\/div>\n<div class=\"ec-flow-item\">Rastet e tjera t\u00eb caktimit t\u00eb masave t\u00eb p\u00ebrkohshme, pothuajse t\u00eb gjitha, lidhen me parandalimin e d\u00ebmit q\u00eb mund t\u00eb shkaktohet brenda vet\u00eb shtetit t\u00eb paditur: vdekje, d\u00ebm i r\u00ebnd\u00eb dhe i pakthyesh\u00ebm p\u00ebr sh\u00ebndetin e nj\u00eb personi q\u00eb ndodhet n\u00ebn kontrollin faktik t\u00eb shtetit, p\u00ebrfshir\u00eb p\u00ebr shkak t\u00eb mosdh\u00ebnies s\u00eb kujdesit t\u00eb duhur mjek\u00ebsor, si dhe ndarje e nj\u00eb f\u00ebmije nga nj\u00eb person i af\u00ebrt. Raste t\u00eb ve\u00e7anta t\u00eb caktimit t\u00eb masave t\u00eb p\u00ebrkohshme kan\u00eb pasur t\u00eb b\u00ebjn\u00eb me zbulimin e burimit gazetaresk, ndalimin e veprimtaris\u00eb s\u00eb medias q\u00eb faktikisht \u00e7on n\u00eb shp\u00ebrb\u00ebrjen e redaksis\u00eb, l\u00ebnien e nj\u00eb personi pa mbrojtje efektive n\u00eb nj\u00eb proces penal, kur ai mund t\u00eb d\u00ebnohej me vdekje, si edhe me masa disiplinore, masa lidhur me statusin ose karrier\u00ebn e gjyqtar\u00ebve dhe masa t\u00eb tjera ndaj gjyqtar\u00ebve ankues, t\u00eb cil\u00ebt i kund\u00ebrshtonin k\u00ebto masa n\u00eb GJEDNJ si nd\u00ebrhyrje n\u00eb ushtrimin e pushtetit t\u00eb tyre gjyq\u00ebsor. S\u00eb fundi, GJEDNJ cakton masa t\u00eb p\u00ebrkohshme p\u00ebr t\u00eb hequr pengesat ndaj ushtrimit efektiv t\u00eb s\u00eb drejt\u00ebs p\u00ebr t\u2019iu drejtuar GJEDNJ-s\u00eb dhe ndaj vijimit t\u00eb nj\u00eb ankimi tashm\u00eb t\u00eb paraqitur.<\/div>\n<div class=\"ec-flow-item\">P\u00ebrve\u00e7 faktit q\u00eb masat e p\u00ebrkohshme mund t\u00eb caktohen vet\u00ebm p\u00ebr list\u00ebn e ngusht\u00eb t\u00eb d\u00ebmeve t\u00eb p\u00ebrmendura, caktimi i tyre k\u00ebrkon p\u00ebrmbushjen e disa kushteve t\u00eb tjera. S\u00eb pari, mund\u00ebsia e shkaktimit t\u00eb d\u00ebmit t\u00eb p\u00ebrmendur m\u00eb sip\u00ebr duhet t\u00eb rrjedh\u00eb nga veprimi ose mosveprimi i shtetit t\u00eb paditur, kund\u00ebr t\u00eb cilit k\u00ebrkohen masat e p\u00ebrkohshme, edhe pse, kur nj\u00eb person transferohet n\u00eb nj\u00eb shtet tjet\u00ebr, shkaktari i drejtp\u00ebrdrejt\u00eb i d\u00ebmit mund t\u00eb jet\u00eb tashm\u00eb ai shtet tjet\u00ebr. Zakonisht ajo varion nga disa qindra euro deri n\u00eb disa mij\u00ebra euro. Koston e sakt\u00eb mund ta p\u00ebrcaktoj vet\u00ebm pas shqyrtimit t\u00eb dokumenteve.<\/div>\n<div class=\"ec-flow-item\">Ky sh\u00ebrbim mbulon p\u00ebrgatitjen e k\u00ebrkes\u00ebs p\u00ebr masa t\u00eb p\u00ebrkohshme, pa p\u00ebrgatitjen e formularit t\u00eb ankimit. N\u00eb k\u00ebrkes\u00eb do t\u00eb formulohet pretendimi p\u00ebr shkelje t\u00eb Konvent\u00ebs vet\u00ebm n\u00eb mas\u00ebn e nevojshme p\u00ebr \u00e7\u00ebshtjen e masave t\u00eb p\u00ebrkohshme. N\u00ebse ju duhet p\u00ebrgatitja e formularit t\u00eb ankimit n\u00eb GJEDNJ, me ose pa k\u00ebrkes\u00eb p\u00ebr masa t\u00eb p\u00ebrkohshme, zgjidhni sh\u00ebrbimin e p\u00ebrgatitjes s\u00eb ankimit n\u00eb GJEDNJ.<\/div>\n<div class=\"ec-flow-item\">Pas marrjes s\u00eb dokumenteve dhe informacionit, do t\u2019ju p\u00ebrgjigjem brenda 24 or\u00ebve. N\u00ebse nuk duket qart\u00eb se ka baza t\u00eb arsyeshme p\u00ebr paraqitjen e k\u00ebrkes\u00ebs p\u00ebr masa t\u00eb p\u00ebrkohshme, do t\u2019ju njoftoj vet\u00ebm p\u00ebr k\u00ebt\u00eb. N\u00ebse duket se ka baza t\u00eb tilla, do t\u2019ju njoftoj koston e p\u00ebrgatitjes s\u00eb k\u00ebrkes\u00ebs, do t\u2019ju k\u00ebrkoj dokumentet konkrete q\u00eb mungojn\u00eb, n\u00ebse \u00ebsht\u00eb e nevojshme, dhe do t\u2019ju d\u00ebrgoj kontrat\u00ebn.
